Restitution ordered in exploitation case

 


A Plains woman was ordered to pay restitution of more than $7,000 in 20th District Judicial Court yesterday after pleading guilty to exploitation of an older person.

Earnie Tempero was the caregiver for a man in his 60s in Plains in 2016 and 2017. Plains Police Department began an investigation in August 2017. As a result, Judge James Manley on Tuesday sentenced Tempero to a five-year suspended sentenced with the Department Corrections, and ordered her to pay restitution of $7,399.19. Court documents had alleged misuse of an ATM card and checks while Tempero was a caregiver.

Also in court on Tuesday, a three-year suspended sentence was revoked for Anthony Waller. The defendant was sentenced in Aug. 2017 on a burglary charge. His suspended sentence was revoked Tuesday after Waller admitted to several instances in which he consumed alcohol, which violated his probation.


Two defendants entered not guilty pleas Tuesday at their respective initial appearances in District Court. Connie Keeton is charged with one county of felony assault with a weapon and one count of felony tampering with or fabricating physical evidence. On June 15, 2018, the Sanders County Sheriff’s Office responded to a call on 3rd Street in Noxon that a woman had shot at a man. Judge Manley denied Keeton’s request for release, “due to she is a flight risk and a danger to the community,” he said.

Michael Stocking entered not guilty pleas to two counts of felony assault of a minor and one misdemeanor charge of partner or family member assault. Stocking was arrested earlier this year in connection with an incident on Highway 212 in Dixon. Sanders County Sheriff’s Office deputies had responded to a 911 call of a possible domestic situation involving Stocking, his girlfriend and his daughter.
