Falls man sentenced on DUI, drug charges

On Tuesday, Judge Deborah “Kim” Christopher sentenced Jeffrey Hernandez to a two-year deferred sentence with the Department of Correction on the charge of misdemeanor DUI, first offense. Hernandez was also sentenced to 10 days in the Sanders County Jail for criminal possession of dangerous drugs (methamphetamine).

Hernandez was arrested Jan. 4, 2018, after his pickup struck a state snow plow at Blue Slide Road and Birdland Bay Road near Thompson Falls.

A Kalispell man made his initial appearance in 20th District Judicial Court on Tuesday, pleading not guilty to five charges stemming from a disturbance at the Sanders County Fair campground last month.

Elijah Westbrook is charged with felony criminal mischief, as well as misdemeanors of criminal mischief, two charges of partner or family member assault, and one assault charge.

Charging documents state that Sanders County Sheriff’s Office responded to a report of a fight at the Sanders County Fairgrounds campground on Sept. 1. Reports from witnesses allege Westbrook became upset when he discovered communication on his girlfriend’s phone between the woman and another male. Documents allege Westbrook kicked and pounded on a vehicle with his girlfriend and child inside, and allegedly punched a male at the scene and threw lawn chairs. Judge Christopher set a trial date of Feb. 4, 2019, for Westbrook.

Marvin Burrell changed his plea to guilty on Tuesday to theft, common scheme, a felony. Court documents alleged that from Dec. 26, 2015, to June 1, 2016, Burrell fraudulently received more than $11,000 in unemployment benefits from the state of Montana. Audits of that time period showed that Burrell was working for Riverside Contracting, Inc., according to charging documents.

With the overpayment of benefits and penalties, documents allege the total owed by Burrell is $17,402.71. Judge Christopher set a sentencing date of Dec. 4 for Burrell.
